Ah, if you read the context in the actual post, it is more clear and less surprising.
Is it?
Yeah, he's commenting specifically on the over-expansion of Federal government powers under the Commerce Clause, actually.
So I can't really argue there. I interpreted the remark to be about the very idea of law based on a constitution, but that's not what he means.
