Well, the decision on the grounds that this is a federal [FAA] issue and not an issue for the states.
The Constitution's commerce clause is often abused by the Court, making everything a federal issue under interstate commerce, but in this case, it seems legit.
If Congress passed a federal law to the same effect, there would [to my best understanding] be no legitimate grounds for challenge.
Perhaps a nice uncontroversial microissue for Sen. Obama to take up when he returns to the Senate in November.
