This is really good, IMO.

And it's an excellent question.

I don't always agree with Greenwald, but I almost always think he's worth reading.

In this case, I agree more-or-less wholeheartedly with the first half of his post, but, shamefully, haven't thought enough about the cases he discusses in the second half. I kinda think he's right...but I just haven't thought about them enough--the question of prosecution, that is.

As for the first half, though: I somewhat disagree about what he says about Trump's comments immediately before the 2021 Capitol Riot. Obviously everything Trump said was protected speech...but I didn't think that was the issue. The issue was that a President should be much more cautious about the things he says--especially in such volatile circumstances.

Anyway.
